FRERET MARKET VENDOR APPLICATION

GENERAL INFORMATION

• The Freret Market is located in the parking lot at Jena and Freret, ½ block off Napoleon
• Parking is available in our reserved lot at Napoleon & S. Robertson; nearby street  parking is for patrons
• The Freret Market shall control ALL publicity and materials relative to the Market
• The Freret Market Board will have the final authority regarding the acceptance or rejection of vendors and their products.
• No security will be provided.

THE FOLLOWING PRODUCTS ARE NOT ALLOWED AT THE MARKET

• Fireworks, firearms, knives
• Any type of drugs/ paraphernalia, tobacco products of any kind, or pharmaceuticals, legal or otherwise
• Stolen merchandise of any kind
• CDs, DVDs, videos which are pirated or dubbed
• New, mass produced items sold in bulk (e x: t-shirts, sunglasses, posters, etc. )
• Pornographic materials
• Any items that by sale or possession are in violation of city, parish, state or federal laws
  
  

BOOTH & VENDOR RULES & REGULATIONS

• Each booth area is approximately 10’ x 10’
• Vendors will supply their own tables, chairs , signage, tents, displays, and racks to hang materials
• The booth must be occupied by the vendor or one of their agents at all times while the Market is open
• Separate vendors may not share booth space; however, if two or more artists work together to produce one product they may apply as a team
• Vendors are allowed to set-up NO EARLIER than 10 a.m. and NO LATER than 11:30 a.m.
• All vendors in the Freret Market must comply with the City of N.O. safe food handling guidelines. (CLICK HERE TO READ FOOD HANDLING GUIDELINES)
• No electricity will be provided for booths
• Please let us know if you have any special needs
• After 11 a.m. , late or no-show spaces will be reassigned those vendors on the waiting list
• No unloading 30 minutes prior to opening; vendors’ booths must be ready before noon 
• No vehicles may be kept on lot during market
• Vendors MUST REMAIN COMPLETELY SET UP UNTIL 5 P.M. and are responsible for the cleanliness of their areas during AND after operation; public receptacles are NOT for vendors’ disposal of market waste
• When the Market Coordinator determines that a vendor has violated any provision that undermines the smooth operation of the Market, a vendor may receive penalties for the following actions:
• The market allows for Acts of god (flat tire, equipment failure, etc.) In those cases call the Market Coordinator immediately.
• No call-no show vendors will receive a 3-month suspension from the Market.
• Selling before or after the designated times or leaving early
• Failure to pay rent for the space; vendors cannot return until rent is received
• All hot food vendors must provide their own fire extinguisher, with an inspection tag from a state fire marshall approved company.  Louisiana Fire and Safety (504.821.8957) is one of those companies.

• $75.00 /Hot food vendors         
• $20.00/Non-Profit vendors
• $60.00/All other vendors

ART & FLEA MARKET VENDORS

• Subleasing is not permitted
• Booth fees must be paid by 8pm on the day before each market.
• Revenues from vendors’ sales will be retained by the vendors. Collecting and paying the appropriate city and state sales taxes on all items sold is the responsibility of the vendors  
• You must submit pictures of your work for your application to be considered.

HOLD HARMLESS CLAUSE

• All authorized vendors participating in the Freret Market shall be individually and severally responsible to the Freret Market(fiscal agent) for any loss, personal injury, deaths, or any other damage that may occur as a result of the vendors negligence or that of it servants, agents, employees, and all vendors hereby agree to indemnify and save the Freret Market harmless from any loss, cost, damages, and other expenses, including attorney fees, suffered or incurred by the Freret Market by reason of the vendors negligence or that of its servants, agents and employees; provided that the vendors shall not be responsible no required to indemnify he Freret Market for negligence, its servants, agents and employees Because no insurance is provided to participants in the Freret Market, each vendor is responsible for his/her own product liability insurance.
• Vendors will not cause or permit any changes, alterations, repairs, painting or staining of any part of the spaces or grounds or furnishing or the equipment thereof, nor permit to be done anything that will damage or change the finish or appearance of any of the Lot . Vendors will pay the costs of repairing any damage done to the lot property or any fixtures thereof by any act of artist or any of the artist’s employees. The Market Coordinator of Freret Market shall determine whether any damage has been done, the amount of the damage, and the reasonable costs of repairing it, and whether it is one for which under the terms of this agreement, the artist is to be held responsible. The Market Coordinators decision is final.
